The Fair and Accurate Credit Transactions Act (FACT Act)
This important new legislation gives consumers a greater role in protecting the quality of their credit and fighting identity theft, and sets higher service requirements for lenders and credit bureaus. "Check 21"
"Check 21" is the nickname for the Check Clearing 21st Century Act, which changes the way institutions process checks. The Act's passage was triggered by the banking problems encountered just after 9/11, and allows for the use of electronic check processing instead of the physical flow of checks from one place to another. Since Fiscal members do not receive cancelled checks with their statements, there will be little outward change from the Act, which went into effect October 28, 2004. However, since electronic checks clear instantaneously, we recommend that members wait until their deposits clear before writing checks against the amount. Direct Deposit of your paycheck is the best way to avoid problems caused by Check 21. Ask your employer, or call Fiscal at
